On 1 July 2016 the Court of Appeal in Warsaw affirmed the appeal filed by Monika Brzozowska, Attorney at Law, a counsel of Piotr Duda, and remitted the case related to the publication in Newsweek of an article entitled "Hotel Robotniczy" for re-examination by the Regional Court.

The article contained information that Piotr Duda is treated like a special guest, takes advantage of his position and disposes the hotel property as if it was his own property. The publication contains information on parcels, fish, strong alcohols received by Piotr Duda, etc.
Piotr Duda sued Tomasz Lis, but the Regional Court in Warsaw dismissed the action. However, the Court of Appeal in Warsaw expressed a different position on the case, stating that formal premises for correction have been met, and the Regional Court has to re-examine the case. The Court of Appeal quashed the previous ruling and remitted the case for re-examination by the Regional Court in Warsaw.
"We are really satisfied with the ruling issued today by the Court of Appeal in Warsaw. The court upheld in the whole the arguments presented by Mr Piotr Duda in the appeal and remitted the case for re-examination by the Regional Court", said Monika Brzozowska – Pasieka, Attorney at Law, counsel of Piotr Duda.
On 7 September 2015 Newsweek published an article by W. Cieśla and M. Krzymowski entitled " Hotel Robotniczy".
In the opinion of Piotr Duda, the article contained untrue information. The article contained information that Piotr Duda is treated like a special guest, takes advantage of his position and disposes the hotel property as if it was his own property. The publication contains information on parcels, fish, strong alcohols received by Piotr Duda, etc.
What is more, the authors claim that both the claimant and his relatives, associates or even his dog enjoy special priority. According to the press material, the dog received a special lair, dog food or even towels embroidered specially for it. Piotr Duda was presented as a person that rests in the luxury Baltic Hotel, which conflicts with the information related to the salaries and treatment of ordinary employees of the Hotel.
Piotr Duda sued editor-in-chief Tomasz Lis and requested correction of untrue and inaccurate information, summed up in 10 points.
