Please be informed that Monika Brzozowska, Attorney at Law, representing her client Czesław Warsewicz, won a lawsuit brought by PKP S.A. against a publicist of nakolei.pl, inter alia because of publishing the information that "PKP is an ineffective and poorly managed entity".
Czesław Warsewicz presented a few opinions on the railway company in his article "Bankowcy wzięli się za kolej". In the opinion of PKP S.A., Cz. Warsewicz damaged the company's reputation by writing (inter alia) that "PKP is badly managed, ineffective and its staff are recruited according to political expectations". PKP S.A. stated that these opinions damage its reputation and undermine its goodwill. PKP pursued damages against Cz. Warsewicz for presentation of critical opinions in the amount of PLN 20,000 and apology, directed both to the company and to the President of the Company's Management Board (despite the fact that the President did not bring an action for violation of his personal goods).
Together with the claim the Company also submitted an application for prohibiting the former President of the Management Board of PKP Intercity to write about PKP S.A. The court finally dismissed the application already in 2014, and consequently it dismissed the action brought by PKP. The proceedings against Cz. Warsewicz were pending before the Regional Court for Warszawa-Praga.
The ruling is final.
